Contract and leaving

German tenancy law protects tenants more than most people expect, which is good news once you understand it. The two things worth knowing before you sign are the minimum stay and the notice period, because neither can be shortened later by agreement.

01What is the minimum stay?

Three months for students, exchange students and interns on a fixed-term contract covering a stated study or internship period. Six months on an open-ended contract. There is no maximum, and plenty of people stay for years.

02How much notice do I have to give?

Three months on an open-ended contract, in writing. In practice: your notice must reach us by the third working day of a month, and the contract then ends at the end of the second month after that. Give notice on 2 March and you leave on 31 May. On a fixed-term contract you give no notice at all, because it ends on the date already agreed.

03Can I leave earlier than that?

Usually yes, through a replacement. Find someone suitable, we check them, and once they sign you are released from the day their tenancy starts. We look for someone too. This is how most people leave early and it normally works, so ask us rather than assuming you are stuck.

04Can I cancel after signing but before I move in?

Yes. Free of charge up to 30 days before your move-in date, with rent and deposit already paid refunded in full. Between 15 and 30 days before, half a month's rent. Fewer than 15 days before, one month's rent, and you can also simply move in later instead. If you booked without a viewing, your 14-day right of withdrawal comes first and costs you nothing at all.

05Can I extend my stay?

Usually. Ask at least six weeks before your end date and we will answer within five working days. If we can extend, we confirm it as a written amendment to your existing contract rather than starting a new one.

06Can YoungNest ask me to leave?

Only for the reasons German tenancy law allows, and with the statutory notice. In practice that means not paying rent or seriously breaching the house rules. We cannot end your tenancy because we would like the room back or have someone who would pay more.
